  1. GENERAL PROVISIONS

  3. These Regulations of the Online Store define the rules for making purchases in the online store: www.quixigo.com, in particular the rules and procedure for concluding distance sales contracts via the Store, as well as the complaint procedure and the procedure for withdrawal from the contract by the Consumer.
  4. In the scope of Services provided electronically, these Regulations are the regulations referred to in Article 9 of the Act on the provision of services by electronic means of 18 July 2002 (consolidated text: Journal of Laws of 2020, item 344, as amended).
  5. These Terms and Conditions are addressed to all Store Customers. All Customers are required to read the Terms and Conditions before making a purchase.
  6. Each Customer is obligated to comply with the provisions of the Terms and Conditions. Sales are based on the version of the Terms and Conditions in effect at the time the order is placed.
  7. Every Customer may review the Terms and Conditions at any time by clicking on the hyperlink "Store Terms and Conditions" on the Store's website: www.quixigo.com . The Terms and Conditions can be downloaded and printed at any time.
  8. All information contained on the Store's website: www.quixigo.com , relating to products (including prices), does not constitute an offer within the meaning of Art. 66 of the Act of 23 April 1964 - the Civil Code (consolidated text: Journal of Laws of 2023, item 1610, as amended), but an invitation to conclude a contract, within the meaning of Art. 71 of the Act of 23 April 1964 - the Civil Code (consolidated text: Journal of Laws of 2023, item 1610, as amended). By sending the Order Form, the Customer makes an offer to purchase and deliver the indicated Goods for the price and under the conditions specified in the description.

  1. DEFINITIONS

Regulations – this set of regulations organizing the rules for using the Store Services by Customers.

Consumer – a natural person concluding an Agreement via the Store, not directly related to his or her business or professional activity.

Entrepreneur with Consumer Rights – a natural person entering into a civil law contract through the Store, directly related to their business activity, when the content of the contract indicates that it is not of a professional nature for that person, arising in particular from the subject of their business activity, disclosed under the provisions of the Central Registration and Information on Business. For the purposes of these Terms and Conditions, it is assumed that, in the absence of a distinction between the two groups of entities, the Terms and Conditions apply to both Consumers and Entrepreneurs with Consumer Rights.

Customer – a natural person (including a Consumer) who is at least 13 years of age (provided that he/she has obtained the consent of his/her legal representative), a legal person and an organizational unit that is not a legal person, to which special provisions grant legal capacity, who uses the Services provided by the Store.

Order Form – A service available on the Store’s website, through which the Customer can make a purchase, in particular by adding Goods to the Cart and specifying certain terms of the Sales Agreement, including the method of delivery and payment.

Shopping Cart – an element of the Store in which the Goods selected by the Customer are visible and in which the Customer can set and modify the Order data, including the quantity of the Products purchased.

Store – an online service belonging to the Seller, available under the domain: www.quixigo.com through which the Customer can purchase Goods from the Seller.

who, while conducting commercial or professional activity, offers sales via his website.

Goods – a movable item traded between the Store and the Customer, the terms of sale of which are specified in the Order Form.

Goods with digital elements – goods containing digital content or a digital service or connected to them in such a way that the lack of the digital content or digital service would prevent it from functioning properly.

Product – any good or service, including real estate, digital services and digital content, as well as rights and obligations.

Digital Environment – ​​computer hardware, software and network connections used by the Consumer to access or use digital content or a digital service.

Integration – combining digital content or a digital service with elements of the Consumer’s digital environment and incorporating them into these elements in order to ensure compliance with the Agreement for the supply of digital content or a digital service.

Compatibility – the interoperability of digital content, a digital service or a good with computer hardware or software that is typically used to use digital content, a digital service or a good of the same type, without the need to transform it.

Functionality – the ability of digital content, digital service or goods to perform their functions, taking into account their intended use.

Interoperability – the ability of digital content, a digital service or a good to work together with hardware or software other than that typically used to access digital content, a digital service or a good of the same type.

Online trading platform – a service using software, including a website, part of a website or an application, operated by or on behalf of an entrepreneur, which enables Consumers to conclude distance contracts with other entrepreneurs or individuals who are not entrepreneurs to conclude distance contracts with other individuals who are not entrepreneurs.

Provider of an online trading platform – an entrepreneur who operates an online trading platform, provides entities with an online trading platform or enables the use of this platform.

Contract – a contract for the sale of Goods at a distance, concluded by the Customer via the Store, usually via the Order Form.


  1. ACCEPTING AND PROCESSING ORDERS
  2. The condition for using the Store is to read and accept these Terms and Conditions. By placing an order, the Customer accepts the Terms and Conditions.
  3. The store operates a dropshipping model for prepaid orders, which includes instant bank transfer, BLIK, or traditional bank transfer. In this case, orders are shipped from a Chinese warehouse and delivered by InPost. All cash-on-delivery orders are shipped traditionally from a warehouse in Poland and delivered by Poczta Polska (Polish Post).
  4. The store designates sponsored offers and paid advertisements. This information is presented directly in relation to a given search result, in a visible manner that stands out from the general interface.
  5. The price stated in the order is the total amount the Customer is obligated to pay, including applicable tax (gross price). Shipping costs are not included in the price, as they depend on the Product delivery method chosen by the Customer.
  6. If the Consumer is required to pay more than the agreed-upon price described in the previous paragraph, the Store will immediately inform the Consumer of this fact, explaining the reason for the price difference. Any additional costs will only be charged to the Consumer with the Consumer's express consent.
  7. The Seller reserves the right to change prices in the Store, introduce new Products for sale, conduct and cancel promotional campaigns, or introduce changes thereto, in accordance with applicable law.
  8. When a promotion is introduced, the Store informs Customers of the lowest price for the Product in the last 30 days. If the Product has been on sale for less than 30 days, the pre-promotion price is the lowest price since the Product was introduced to the Store. This information is presented next to the Product's promotional price.
  9. Orders from Customers are accepted via the Order Form sent via the website: www.quixigo.com or by e-mail to the address: quixigo@gmail.com , 7 days a week, 24 hours a day.
  10. The Product Order is placed by selecting the Goods the Customer is interested in, clicking the "ADD TO CART" button next to the Product description, and then, from the "CART" level in the Store tab, completing the Order Form, including selecting the delivery and payment method or selecting the cash on delivery option, if available for the selected Product, and then clicking the purchase confirmation.
  11. Entrepreneurs with consumer rights should indicate, at the time of placing an order for Products, that the purchase is not of a professional nature for them.
  12. After placing the order, the Customer receives order confirmation to the e-mail address provided in the Order Form.
  13. After the Customer receives confirmation of acceptance of the offer, the process of order fulfillment by the Seller begins, whereby:

a) in the case of placing an order paid on delivery – it starts at the latest on the next business day after its confirmation by the Seller.

b) in the case of placing an order paid by traditional transfer – the processing begins after the payment for the placed order is credited to the Store’s bank account.

  1. Orders placed in the Store are processed during Store opening hours (Monday through Friday, 10:00 a.m. to 4:00 p.m.). Orders placed on weekdays after 4:00 p.m., on Saturdays, Sundays, or public holidays will be processed the next business day.
  2. The Customer will receive a message confirming that the order has been accepted for processing, which is understood as the Seller's declaration of acceptance of the offer. Upon receipt by the Customer, a Sales Agreement is concluded.
  3. A VAT receipt is issued for every order. At the Customer's request, a VAT invoice will also be issued and sent to the Customer (Article 106b, paragraph 3 of the Act of 11 March 2004 on Goods and Services Tax, Journal of Laws of 2023, item 1570, as amended).
  4. The available means of communication between the Customer and the Store are:

  1. The Seller does not verify the authenticity of Customer reviews regarding Products purchased in the Store.

  1. DELIVERY AND TRANSPORT COSTS
  2. The delivery of orders in the Store is carried out via courier.
  3. Orders placed in the Store are processed only on business days. Orders placed on Saturdays, Sundays, and public holidays will be processed the next business day.
  4. The average waiting time for a shipment is 8 business days. This waiting time includes the order processing time, which includes assembling the Products for the order, and the estimated delivery time, which is 24 hours for Poland.
  5. The Seller is not responsible for delays resulting from the fault of the carrier.
  6. Upon receipt of a parcel delivered by a courier, the Customer should carefully inspect the contents and completeness of the parcel, the condition of the external packaging, and the condition of the ordered Product in the courier's presence. In the event of damage to the parcel, the Customer should complete a damage report with the courier, in two identical copies signed by the Customer and the courier.

  1. PAYMENT PROCESSING
  2. The following payment methods are available within the Store:
    1. by transfer;
  3. Detailed rules and conditions for making payments through banks or other available services are specified in the relevant regulations of the relevant banks and services.
  4. Customers who choose to pay by bank transfer are obligated to pay for their order within five (5) business days of placing the order. Otherwise, the Seller's offer is not binding and the order will be deleted from the system. Simply provide the order number in the payment reference. The payment deadline can be extended by notifying the Store staff: quixigo@gmail.com (email), GOLDEN SAUNAS, ul. OSSOWSKIEGO 51/4, 46-203 KLUCZBORK, OPOLSKIE VOIVODESHIP.

  1. COMPLAINT
  2. The Seller is liable for any non-conformity of the Product with the Agreement. The provisions of the Act of 23 April 1964, the Civil Code (consolidated text: Journal of Laws of 2023, item 1610, as amended), regarding warranty for defects, do not apply to agreements requiring the transfer of ownership of the Goods to the Consumer, including in particular sales agreements, delivery agreements, and contracts for specific work constituting the Goods.
  3. The Seller is liable for any lack of conformity of the Product with the Agreement that exists at the time of delivery and becomes apparent within two (2) years of that date, unless the expiration date of the Product, as determined by the Seller, its legal predecessors, or persons acting on their behalf, is longer. Any lack of conformity of the Product with the Agreement that becomes apparent within two (2) years of delivery is presumed to have existed at the time of delivery, unless proven otherwise or unless this presumption is inconsistent with the nature of the Product or the nature of the lack of conformity.
  4. If the Product does not conform to the Agreement, the Consumer may request its repair or replacement. The Seller may replace the Product if the Consumer requests a repair, or the Seller may repair the Product if the Consumer requests a replacement, if bringing the Product into conformity with the Agreement, in the manner chosen by the Consumer, is impossible or would require excessive costs for the Seller. If repair or replacement are impossible or would require excessive costs for the Seller, the Seller may refuse to bring the Product into conformity with the Agreement.
  5. The Seller will repair or replace the Product within a reasonable time from the moment the Consumer notifies them of the lack of conformity with the Agreement, and without undue inconvenience to the Consumer, taking into account the nature of the Product and the purpose for which the Consumer purchased it. The costs of repair or replacement, including, in particular, postage, shipping, labor, and materials, are borne by the Seller. For this purpose, the Consumer will make the Product available to the Seller for repair or replacement. The Seller will collect the Product from the Consumer at its own expense. If the Product was installed before the lack of conformity was discovered, the Seller will disassemble the Product and reassemble it after the repair or replacement, or arrange for this work to be performed at its own expense.
  6. If the Product is non-conformity with the Agreement, the Consumer may submit a declaration of price reduction or withdrawal from the Agreement when: a) the Seller has refused to bring the Product into conformity with the Agreement; b) the Seller has failed to bring the Product into conformity with the Agreement; c) the lack of conformity of the Product with the Agreement persists despite the Seller having attempted to bring the Product into conformity with the Agreement; d) the lack of conformity of the Product with the Agreement is so significant that it justifies a price reduction or withdrawal from the Agreement, without prior requesting its repair or replacement; e) it is clear from the Seller’s statement or the circumstances that he will not bring the Product into conformity with the Agreement within a reasonable time or without excessive inconvenience to the Consumer.
  7. The reduced price must be proportional to the price under the Agreement to the value of the Product that is inconsistent with the Agreement. The Seller shall refund to the Consumer any amounts due as a result of exercising the right to reduce the price immediately, but no later than fourteen (14) days from the date of receipt of the Consumer's notice of the price reduction.
  8. The Consumer may not withdraw from the Agreement if the Product's lack of conformity with the Agreement is immaterial. It is presumed that the Product's lack of conformity with the Agreement is material.
  9. In the event of withdrawal from the Agreement, the Consumer shall immediately return the Product to the Seller at the Consumer's expense. The Seller shall refund the price to the Consumer immediately, no later than fourteen (14) days from the date of receipt of the Product or proof of its return, using the same payment method used by the Consumer, unless the Consumer has expressly agreed to a different payment method that does not incur any costs for the Consumer.

  11. The Seller will respond to the Consumer's complaint within 14 calendar days of receiving it. Failure to respond within this timeframe will mean the complaint is deemed justified.
  12. The complaint should include:

a) details of the person submitting the complaint (name and surname, mailing address, e-mail address); b) indication of the reason for the complaint and the content of the request; c) Order number, as shown in the Order confirmation; d) the original or a copy of the proof of purchase (e.g. receipt or invoice) may facilitate the submission of a complaint, but is not necessary for its submission.

  1. The above provisions do not exclude the possibility of the Seller providing a warranty for purchased Products, which is provided for in separate warranty regulations.

  1. RIGHT OF WITHDRAWAL
  2. Pursuant to the Act of 30 May 2014 on Consumer Rights (consolidated text: Journal of Laws of 2020, item 287, as amended), the Consumer may withdraw from the Agreement concerning Products purchased in the Store, without giving any reason, by submitting an appropriate declaration in writing, within fourteen (14) days from the date of delivery of the Goods (i.e. from the date of receipt of the Goods by the Consumer). This deadline is deemed to have been met if the Consumer sends the declaration before its expiry.
  3. The Consumer may withdraw from the Agreement by submitting a declaration of withdrawal to the Seller. A template for the declaration is attached as Appendix 1 to these Terms and Conditions.

  5. The Consumer must return the Goods to the Seller within fourteen (14) days of the date on which they withdrew from the Agreement. To meet the deadline, it is sufficient to return the Goods before its expiry.
  6. The consumer bears only the direct costs of returning the Goods.

  8. The Seller shall, within fourteen (14) days from the date of receipt of the declaration of withdrawal from the Agreement, refund to the Consumer all payments made by him, including the cost of delivery of the Goods, provided that the refund will not be made until the Goods are received back or the Consumer provides proof of sending them back.
  9. If the Consumer has chosen a method of delivery of the Goods other than the cheapest method of delivery offered by the Seller, the Seller is not obliged to reimburse the Consumer for the additional costs incurred by him.
  10. The Seller will refund the payment using the same payment method used by the Consumer.
  11. The Consumer is liable for any reduction in the value of the Product resulting from its use in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the Product.
  12. The right to withdraw from the Sales Agreement does not apply to the Consumer in relation to the Agreement:

a) in which the subject of the provision are non-prefabricated Goods, manufactured according to the Consumer’s specification or intended to meet their individual needs; b) in which the subject of the provision are Goods that spoil quickly or have a short shelf life; c) in which the subject of the provision are alcoholic beverages, the price of which was agreed upon at the conclusion of the Agreement, the delivery of which can only take place after 30 days and the value of which depends on market fluctuations over which the Seller has no control; d) in which the subject of the provision are Goods delivered in sealed packaging, which cannot be returned after opening the packaging for health protection or hygiene reasons if the packaging was opened after delivery; e) in which the subject of the provision are Goods which after delivery, due to their nature, are inseparably combined with other goods; f) in which the subject of the provision are audio or visual recordings or computer programs delivered in sealed packaging if the packaging was opened after delivery; g) for the supply of newspapers, periodicals or magazines, with the exception of a subscription agreement; h) in which the price or remuneration depends on fluctuations in the financial market over which the Seller has no control and which may occur before the expiry of the period for withdrawal from the Agreement; i) for the supply of Goods with digital elements, digital services or digital content, not supplied on a tangible medium, for which the Consumer is obliged to pay the price, if the Seller commenced the provision with the express and prior consent of the Consumer, who was informed before the commencement of the provision that after the Seller has fulfilled the service he will lose the right to withdraw from the Agreement, and has acknowledged this, and the Seller has provided him with confirmation; j) concluded by way of a public auction; k) for the provision of accommodation services other than for residential purposes, transport of goods, car rental, catering, services related to leisure, entertainment, sporting or cultural events, if the Agreement specifies the day or period of service provision; l) in which the Consumer has expressly requested the Seller to come to him for urgent repair or maintenance; if the Seller provides additional services other than those requested by the Consumer, or supplies goods other than spare parts necessary to perform the repair or maintenance – the Consumer has the right to withdraw from the Agreement in respect of additional Services or Goods; m) for the provision of services for which the Consumer is obliged to pay the price, in the case where the Consumer has expressly requested the Seller to come to him for repair and the service has already been fully performed with the express and prior consent of the Consumer.

  1. The right to withdraw from a Distance Contract is available to Consumers and Entrepreneurs with Consumer rights.

  1. OUT-OF-COURT DISPUTE RESOLUTION
  2. If the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, among others:
    • Mediation is conducted by the relevant Provincial Trade Inspectorate, to which a request for mediation should be submitted. As a rule, the proceedings are free of charge. A list of Inspectorates can be found at: https://www.uokik.gov.pl/wazne_adresy.php#faq595 .
    • Assistance from the locally competent permanent consumer arbitration court, operating at the Provincial Inspectorate of Trade Inspection, to which an application for consideration of the case before the arbitration court should be submitted. As a rule, the proceedings are free of charge. A list of courts is available at: https://www.uokik.gov.pl/wazne_adresy.php#faq596 .
    • Free assistance from the municipal or district consumer ombudsman.
    • The ODR online platform, available at: http://ec.europa.eu/consumers/odr/ .
  3. This chapter entitled “Out-of-court dispute resolution” does not apply to Entrepreneurs with consumer rights.

  1. PERSONAL DATA PROTECTION
  2. By placing an order, the Customer consents to the processing of personal data provided by him/her for the purpose of fulfilling and servicing the order by the Seller, who is also the controller of personal data within the meaning of Article 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), OJ L 119, 4 May 2016, pp. 1–88.
  3. The administrator of personal data provided by the Customer when using the Store is the Seller.
  4. Personal data contained in the Seller's database are not transferred to entities that are not involved in the execution of the Agreement.
  5. In accordance with Article 15 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), OJ L 119, 4 May 2016, pp. 1–88, the Customer has the right to access their personal data and may request their correction or deletion. The Seller ensures that each Customer has the right to control the personal data being processed.
  6. Providing personal data is voluntary, however, the lack of consent to the processing of personal data makes it impossible to complete the Customer's order.
  7. Detailed information regarding personal data and privacy protection is included in the "Privacy Policy" tab on the Store's website.

  1. FINAL PROVISIONS
  2. The Regulations define the rules for concluding and performing the Sales Agreement for Products available on the Store's website.
  3. The sales contract is concluded between the Customer and the Seller.
  4. The Regulations are available to all Customers in electronic form on the Store's website: www.quixigo.com in the "Store Regulations" tab.
  5. In order to use the Store Services, it is necessary to have devices that allow access to the Internet and a web browser that allows the display of websites, as well as to provide an e-mail address that allows for sending information regarding the execution of the order.
  6. All persons, including Customers, are prohibited from posting illegal content on the Store's website.
  7. In matters not regulated by these Regulations, the relevant provisions of generally applicable law shall apply.
  8. The Terms and Conditions do not exclude or limit any rights of the Customer who is a Consumer, which they are entitled to under mandatory provisions of law. In the event of a conflict between the provisions of the Terms and Conditions and mandatory provisions of law granting rights to consumers, the provisions of law shall prevail.
  9. The provisions of the Regulations that are less favorable to the Consumer than the provisions of the Act of 30 May 2014 on consumer rights (i.e. Journal of Laws of 2020, item 287, as amended) are invalid and the provisions of the Act shall apply in their place.
  10. If any provision of these Terms and Conditions is or becomes invalid or unenforceable, the validity of the entire Terms and Conditions will remain unaffected. In such a case, the Parties will replace the invalid or unenforceable provision with another that most closely reflects the intended economic purpose. This also applies to any gaps in the Terms and Conditions.

WITHDRAWAL FORM FOR A CONTRACT BY A CONSUMER OR AN ENTREPRENEUR WITH CONSUMER RIGHTS

Hereby, acting under Article 27 of the Act of 30 May 2014 on Consumer Rights (consolidated text: Journal of Laws of 2020, item 287, as amended), in the following wording:

Article 27 of the Consumer Rights Act

A consumer who has concluded a distance or off-premises contract may withdraw from it within 14 days without giving any reason and without incurring any costs, except for the costs specified in Article 33, Article 34 paragraph 2 and Article 35.

Instruction:

The Consumer, as well as the Entrepreneur with Consumer rights, has the right to withdraw from the Agreement within 14 days without giving any reason, and in the case of a Agreement concluded during an unscheduled visit to the Consumer's place of residence, habitual stay, or on a trip – within 30 days. The period for withdrawal from the Agreement expires after 14 days from the date of conclusion of the Agreement or on which the Consumer came into possession of the item/batch or part, or on which a third party other than the carrier and indicated by the Consumer came into possession of the item/batch or part, and in the case of a Agreement concluded during an unscheduled visit to the Consumer's place of residence, habitual stay, or on a trip – after 30 days from the date of coming into possession of the item/batch.

In order to exercise the right of withdrawal, the Consumer must inform the Seller, i.e. Quixi go, at the following address: Golden Saunas Sp. z o. o., ul. OSSOWSKIEGO 51/4, 46-203 KLUCZBORK, OPOLSKIE, to the e-mail address: quixigo@gmail.com, of their decision to withdraw from the Agreement by means of an unequivocal statement sent by post or email. The Consumer may use the model withdrawal form attached to these Terms and Conditions, which is not mandatory. The deadline is deemed to have been met if the Consumer sends information regarding the exercise of their right to withdraw from the Agreement before the expiry of the withdrawal period. The Consumer should return or deliver the Product to the Seller at the following address: Golden Saunas immediately, and in any case no later than 14 days from the day on which they informed the Seller of their withdrawal from the Agreement. This deadline is deemed to have been met if the Consumer returns the Product to the Seller before the expiry of the 14-day period.

In the event of withdrawal from the Agreement, the Seller shall refund all payments received from the Consumer, including the costs of delivery of the Product (excluding additional costs resulting from the Consumer's choice of a delivery method other than the cheapest and standard delivery method offered by the Seller), immediately, and in any event no later than 14 days from the day on which the Seller was informed of the Consumer's intention to exercise the right of withdrawal. The Seller may withhold the refund until the Product is received or until the Consumer provides proof of having sent back the Product, whichever occurs first. The Seller will refund the payment using the same payment method that the Consumer used in the original transaction, unless the Consumer has expressly agreed otherwise – in any case, the Consumer will not incur any fees in connection with this refund. Cash refunds cannot be sent to a home address. Refunds are only possible to a bank account.
